Kaenz Yacht Terms of Service

Effective Date: February 23, 2026

IMPORTANT: PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE KAENZ APP.

By creating an account, listing a yacht, offering captain services, or booking a trip on the Kaenz Yacht mobile application or website (“Platform”, “we”, “us”, “our”), you agree to be legally bound by these Terms of Service.

If you do not agree, you may not use the Platform.

1. Definitions

Client / User: Any person who books or participates in a yacht trip through the Platform.
Yacht Owner: Any person or entity who lists a yacht for charter on the Platform.
Captain: Any licensed captain who provides navigation and safety services for a booked trip.
Platform / Kaenz Yacht: The marketplace technology connecting Clients, Yacht Owners, and Captains.
Trip: A private, crewed yacht experience booked through the Platform (with captain).

2. Our Role

Kaenz Yacht is a technology platform only. We are not a charter operator, boat owner, or employer of captains. We do not own, operate, or control any yachts or captains. All trips are provided directly by independent Yacht Owners and Captains.

3. Eligibility & Account Registration

You must be at least 18 years old.
You must provide accurate information and keep it updated.
Clients must have a valid government-issued ID.
Yacht Owners must own the yacht and provide valid Florida registration, HIN, and proof of insurance.
Captains must hold a current USCG Merchant Mariner Credential (OUPV “Six-Pack” or higher) and any required FWC Charter Captain License. They must pass our background check.

4. Role-Specific Terms

4.1 For Clients / Users

You are responsible for your own safety and behavior during the trip.
You must follow all instructions from the Captain.
You agree not to bring illegal substances, weapons, or engage in dangerous activities.
Cancellations and refunds are governed by the trip’s cancellation policy (visible before booking).
We are not liable for any injury, loss, or damage caused by the Yacht Owner, Captain, weather, or any third party.

4.2 For Yacht Owners

You must maintain valid registration, USCG documentation (if applicable), and commercial marine insurance (minimum $1,000,000 liability).
Your yacht must be in seaworthy condition and meet all safety requirements.
You are responsible for all maintenance, fuel (unless otherwise agreed), and cleaning after each trip.
You grant Kaenz Yacht a non-exclusive license to display photos and details of your yacht.
You are solely responsible for any damage to your yacht caused by Clients (we facilitate damage claims).
You agree to pay all applicable taxes on income received.

4.3 For Captains

You must hold and maintain a valid USCG license and any required FWC license.
You are responsible for the safe navigation, safety of all passengers, and compliance with all USCG and Florida boating laws.
You must perform a safety briefing before departure and carry all required safety equipment.
You are an independent contractor. Kaenz Yacht does not employ you.
You are responsible for your own taxes, insurance, and worker’s compensation (if applicable).

5. Bookings, Payments & Fees

All bookings are final once confirmed by the Yacht Owner/Captain.
Payments are processed through our secure system (fiat or cryptocurrency on Solana).
Cryptocurrency payments are irreversible once sent.
Kaenz Yacht fee is 30% of the total booking amount (paid by the Client). The remaining 70% is split between Yacht Owner (40%) and Captain (30%).
All prices shown include the Platform fee unless stated otherwise.
You are responsible for any additional charges (fuel surcharge, add-ons, taxes on add-ons, etc.).

6. Cancellations & Refunds

Cancellations are subject to the policy shown at the time of booking.
Weather-related cancellations decided by the Captain are generally fully refunded.
No-shows by Clients are non-refundable.

7. Insurance & Liability

Yacht Owners must carry commercial marine liability insurance.
Kaenz Yacht provides optional supplemental P2P insurance for Clients (terms available at booking).
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAENZ YACHT IS NOT LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES arising from use of the Platform or any Trip.
You release Kaenz Yacht, its officers, directors, employees, and agents from all claims related to any Trip.

8. Prohibited Conduct

You may not:

Use the Platform for any illegal purpose.
Misrepresent information about your yacht, license, or qualifications.
Harass, threaten, or harm other users.
Attempt to circumvent our fee structure.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy (link in app and website).

10. Dispute Resolution

Any dispute will be resolved by binding arbitration in Miami-Dade County, Florida, under American Arbitration Association rules.
You waive your right to a jury trial.
Governing law: State of Florida (without regard to conflict of laws).

11. Termination

We may suspend or terminate your account at any time for violation of these Terms, without notice or refund.
